Discipline hearing dates have been set for Sault Ste. Marie sports physician Dr. Brian Shamess, facing allegations of professional misconduct. Hearings will take place in Toronto May 7-11 and June 18-22. According to the College of Physicians and Surgeons of Ontario, it is is alleged that Shamess engaged in the sexual abuse of Patient A and/or in “disgraceful, dishounorable or unprofessional” conduct by, among other things, inappropriate and/or sexual comments to her regarding her appearance and inappropriate, sexual and/or physical contact with the patient’s breasts and back. Additional allegations of professional misconduct have been referred to the college’s discipline committee, charging that Shamess engaged in the sexual abuse of Patient B and/or in “disgraceful, dishonourable or unprofessional” conduct by, among other things, engaging in inappropriate and/or sexual contact with the individual’s breasts and back. It is also alleged that Shamess engaged in the sexual abuse of Patient C and/or in “disgraceful, dishonourable or unprofessional” conduct by, engaging in inappropriate and/or sexual contact with the individual’s pelvis. Shamess says there is "absolutely no basis" to the charges. "The disciplinary hearing will be an opportunity for me to respond to the allegations, prove that they are completely meritless, and then move on from what has been an extremely stressful and unwarranted ordeal," he wrote earlier in an e-mail to The Sault Star. "I wish to extend my heartfelt appreciation to my patients, colleagues and members of the community for your overwhelming support." If the college finds Shamess has committed an act or acts of professional misconduct, the panel may make one or more of the following orders under Subsection 51 (2) of the code: — direct the registrar to revoke the member's certificate of registration; — direct the registrar to suspend the member's certificate of registration for a specified period of time; — direct the registrar to impose specified terms, conditions and limitations on the member's certificate of registration for a specified or indefinite period of time; — require the member to appear before the panel to be reprimanded; — require the member to pay a fine of not more than $35,000. If Shamess does not attend the hearing, the discipline panel may proceed in his absence and Shamess will not be entitled to any further notice of the proceedings.
